When you are involved in an accident caused by another person, your compensation will typically cover medical expenses, property damage, and lost wages. However, in some cases, you may be awarded punitive damages, which serve a different purpose. Punitive damages are only awarded under specific circumstances that go beyond ordinary negligence. This blog discusses these damages and their role in the legal system.

What Are Punitive Damages?

Unlike typical compensatory damages that aim to restore the victim’s financial losses, punitive damages punish the responsible party. In addition, punitive damages are awarded to deter similar behavior in the future. Punitive damages are granted above the amount that would compensate the victim for their losses.

The legal system reserves punitive damages for cases that involve particularly egregious behavior. Actions that demonstrate a reckless disregard for the safety of others or intentional misconduct may prompt a judge to award punitive damages to the victim. Punitive damages convey to the wrongdoer and road users in general that society will not tolerate such behavior.

When Are Punitive Damages Awarded in Car Accident Cases?

Punitive damages are not commonly awarded in standard car accident cases. Ordinary negligence, such as failing to yield at an intersection, may not qualify for punitive damages. Courts will consider awarding punitive damages in situations where the at-fault party acted with malice, gross negligence, or willful disregard, such as:

  • Driving under the influence of drugs or alcohol
  • Extreme cases of distracted driving
  • Street racing that results in injuries or fatalities
  • Hit-and-run accidents
  • Road rage incidents where the accident was caused deliberately
  • Accidents caused by a driver with a history of dangerous behavior

The Legal Threshold for Punitive Damages

Obtaining punitive damages involves significant legal hurdles. Typical compensatory damages require proof of negligence by what is known as a “preponderance of evidence,” meaning there is a greater than 50% chance that the claim is valid. However, punitive damages need a higher standard of proof, which requires “clear and convincing evidence.”

The plaintiff must demonstrate that the defendant caused the accident and their conduct was so atrocious that it warrants additional punishment. Proving this extreme behavior requires thorough investigation, expert testimony, accident reconstruction, and the presentation of irrefutable evidence.

State Variations in Punitive Damage Laws

Punitive damages vary by jurisdiction and are handled differently in each state. In California, punitive damages can be awarded if there is clear and compelling evidence of malice, oppression, or fraud. Most states will likely award punitive damages if the defendant’s actions are reprehensible.

Some states impose caps on punitive damages by limiting them to a specific amount. Other states may cap punitive damages at three times the total compensatory amount. California has no official limit for punitive damages. However, the Supreme Court has ruled that these damages should be proportionate to the harm caused.

Real World Examples

It can be helpful to discuss examples of situations where these damages may be awarded to understand the magnitude of the actions that warrant punitive damages. Let’s consider two examples: drunk driving and truck accidents.

  1. A driver with a history of multiple DUI convictions causes a serious accident with a blood alcohol volume that is twice the legal limit. Courts will most likely award punitive damages because the driver knowingly endangered others after repeated warnings. The driver’s actions would be classified as willful misconduct.
  2. A truck driver caused a serious accident, but investigation reveals that the trucking company falsified records. If there is proof that the company pushed their drivers to exceed legal hour limits, which led to driver fatigue and the subsequent accident, the company can be forced to pay punitive damages.

Legal Strategy

If you’re involved in an accident where the other driver’s actions were explicitly negligent or reckless, it’s imperative to discuss punitive damages with your attorney. However, you must remember that pursuing punitive damages often requires trialing a case. Many insurance policies exclude coverage for punitive damages, so you may be unable to negotiate a settlement.

Before deciding to proceed to trial, weigh the strength of your evidence, the additional time and expense of a trial, and the likelihood of a favorable judgment. Your attorney will guide you through the pros and cons of pursuing punitive damages and help you determine whether they are worth the possible legal battle to obtain them.

Holding Reckless Drivers Accountable

Punitive damages are a critical legal tool for addressing harmful behavior. If a defendant is found guilty of demonstrating an extreme disregard for the safety of others, punitive damages can act as a punishment and deterrent. Remember, while punitive damages can provide additional compensation, they are the exception, not the rule.
