I was rear ended in an auto accident. The other driver fled the scene. My auto insurance decided they wanted to be of little help. They lied, denied me medical coverage, and strung me along for 5 months before finally totaling my vehicle. I was left in a medical/ auto limbo with no one to help since my insurance wouldn't answer my calls/ emails. It wasn’t until HHJ trial attorneys got involved that my insurance started providing the coverage they were suppose to from the start. Kamil Robinson from HHJ was there every step of the way to explain things and answer any questions no matter what time of day. First and foremost he made sure I received the medical care I needed and made sure my auto insurance held up their end of the bargain. Kamil along with Freesia Farris really helped me navigate and move past an unpleasant situation I was dealt. If it wasn’t for HHJ the outcome would have been a lot different. Thanks again Kamil and everyone at HHJ!

I consulted with Emma for an employment issue. I was under a lot of stress and she was absolutely kind, patient and compassionate and listened to all the details of my issue. Although this was not a topic of their practice, she spent time providing me several resources that could help me and get me started. I felt cared for by her welcoming communication and not rushed even though she knew she wouldn’t be able to help or make money from my case, that didn’t prevent her from supporting me and give me recommendations. Thank you Emma 🙏

Michael and his team were so great during this entire process. They helped me to get a pretty significant settlement from my case and they were never delayed in any of the processes. I am confident that had I not "fired" the first attorney that I started to work with and called HHJ trail attorneys, I would not have gotten the results that I got with HHJ. You can't go wrong with working with these guys to settle your case.

Michael and the HHJ staff were extremely helpful from the start of my case less than a year ago. From the time I had my accident, to having doctor appointments set up to the final conclusion, it couldn’t have been a smoother process from beginning to end. Michael is very detailed and organized and always has your best interest at heart. He is very responsive and is always on top of it. I didn’t have to do much other than show up to my doctor appts and respond with info that was needed. I would without a beat use Michael and his team again if needed. HHJ is the best in Southern California!

How Common are Dog Bites in California?

Dog bites are a significant concern in California, which is known for having a high rate of such incidents. Each year, around 4.5 million dog bites are reported across the United States. In California specifically, more than 488 out of 3,600 dog bite claims nationwide were recorded by State Farm insurance in 2017, representing approximately 14% of all dog bites in the country. This indicates that California has a relatively high incidence of dog bites compared to other states.

Regarding the severity and demographics of these incidents, it’s noted that children less than 10 years of age frequently visit emergency departments for injuries from dog bites, more often than other age groups. Additionally, children are more than three times more likely to be bitten on the head or face. Overall, there are around 885,000 dog bite victims in the United States who require critical medical care annually. The majority of these bites result in non-fatal injuries, but a small fraction can lead to serious injuries or even death. For example, in 2020, there were 45 dog bite-related fatalities in the United States, with 29 of those victims being children.

The breeds most associated with these incidents vary. Pit Bulls, Rottweilers, and German Shepherds are often cited in various studies as having higher percentages of reported dog bites. However, it’s essential to note that breed alone is not a reliable indicator of a dog’s tendency to bite. Factors like training, socialization, and the dog’s environment play significant roles in their behavior.

In terms of financial impact, the average dog bite settlement amount in the United States is over $64,000, and in 2020, insurance companies paid approximately $854 million for dog bite injuries.

These statistics highlight the importance of responsible pet ownership, including proper training, socialization, and adherence to local laws and regulations to prevent dog bites.

What Types of Injuries Can Be Caused from Dog Bites?

Dog bites can cause a variety of injuries, ranging from minor to severe. The extent and type of injury depend on several factors, such as the size and breed of the dog, the location of the bite, and the duration of the attack. Here are some common types of injuries caused by dog bites:

  1. Puncture Wounds: Dog bites often result in puncture wounds from the dog’s teeth. These can vary in depth and severity. Deeper puncture wounds can damage muscles, tendons, nerves, and bones.

  2. Lacerations and Abrasions: Dogs’ teeth can cause cuts (lacerations) and scrapes (abrasions) on the skin. These can range from superficial to deep and may require stitches.

  3. Infections: Dog bites can introduce bacteria from the dog’s mouth into the wound, leading to infections. Common bacteria include Pasteurella, Streptococcus, and Staphylococcus. Infections can sometimes lead to more serious conditions if not treated promptly.

  4. Rabies: Although rare, especially in domesticated pets, there is a risk of rabies transmission through dog bites. Rabies is a serious viral infection that affects the nervous system.

  5. Crush Injuries: Larger or more powerful breeds can exert significant force, leading to crush injuries. These injuries can affect deeper tissues and bones, and in severe cases, may lead to fractures.

  6. Scarring and Disfigurement: Severe dog bites, especially on visible areas like the face, can lead to scarring and disfigurement. Reconstructive surgery may sometimes be necessary.

  7. Nerve Damage: Deep bites can cause nerve damage, leading to loss of sensation or function in the affected area.

  8. Psychological Trauma: Beyond physical injuries, dog bites can cause significant psychological trauma, including fear of dogs, anxiety, and post-traumatic stress disorder (PTSD).

  9. Tetanus: If a bite breaks the skin, there’s a risk of tetanus, a bacterial infection affecting the nervous system.

  10. Emotional Distress: Victims of dog bites, especially children, can experience emotional distress and develop a long-term fear of dogs.

It’s important to seek medical attention immediately after a dog bite, especially if the wound is deep, bleeding, or showing signs of infection. Medical professionals can assess the injury, provide necessary treatment, and advise on rabies and tetanus vaccinations if needed.

Can I Sue If I've Been Bitten By a Dog?

Yes, you can sue if you’ve been bitten by a dog. The specifics of the lawsuit depend on the state and city laws governing dog bites and the circumstances of the incident. In general, dog owners may be held liable for injuries caused by their dogs. This liability can arise from statutes specifically addressing dog bites, knowledge of the dog’s dangerousness, or general principles of negligence.

  1. Statutes for Dog Bites: In some jurisdictions, there are specific laws that make the dog owner automatically liable for any injury caused by a dog bite, unless the dog was provoked.

  2. Knowledge of Danger: Under the “one-bite rule” applicable in some places, a dog owner may be liable if they knew the dog was dangerous because it had bitten someone in the past. Here, the burden is often on the victim to prove that the owner knew about the dog’s propensity to bite.

  3. Negligence: Dog owners can also be found negligent if they failed to take reasonable steps to prevent the dog bite, such as properly securing their pet or controlling it on a leash.

In terms of compensation, if the dog owner has adequate insurance to cover medical care, you might not need to file a lawsuit. However, if the insurance coverage is insufficient or if the owner is uncooperative, a lawsuit might be necessary. Compensation can cover medical treatment, lost wages, permanent disfigurement, disability, pain, and emotional suffering. The amount of compensation depends on the severity of the injuries and the specific circumstances of the case.

The average settlement for a severe dog bite injury can be around $40,000, but this varies based on the actual injuries and financial damages suffered. In cases involving visible scarring, disfigurement, or permanent disability, settlements can exceed $100,000 or even $200,000.

It’s advisable to consult with a lawyer experienced in dog bite cases to understand your rights and the best course of action in your specific situation.

What Evidence Do I Need To Give a Vista Dog Bite Attorney?

If you’re working with a dog bite attorney in Vista or any other location, you will need to provide various pieces of evidence to build a strong case. Here’s a list of the types of evidence typically required:

  1. Medical Records: This includes all documents related to medical treatment you received for the dog bite. These records are crucial to prove the extent and nature of your injuries.

  2. Photographs of Injuries: Take clear photos of your injuries immediately after the bite and during various stages of healing. These photos can be powerful evidence of the severity of the bite.

  3. Witness Statements: If there were any witnesses to the incident, their accounts could be vital. Collect names, contact information, and, if possible, written statements from them.

  4. Police/Animal Control Reports: If you reported the incident to the police or animal control, obtain a copy of the report. This official documentation can provide an unbiased account of the incident.

  5. Documentation of Lost Wages: If your injuries caused you to miss work, collect evidence of lost wages, such as pay stubs or a letter from your employer.

  6. Documentation of Other Financial Losses: Keep receipts or records of all expenses related to the dog bite, including medical bills, medication costs, travel expenses for medical treatment, and any other related costs.

  7. Evidence of the Dog’s History: If possible, gather information about the dog’s past behavior. This could include previous attacks or aggressive behavior.

  8. Photographs of the Location of the Attack: Pictures of where the attack happened can help illustrate the circumstances of the incident.

  9. Communication Records: Save any communication you’ve had with the dog’s owner or their insurance company, including emails, texts, and notes from phone conversations.

  10. Your Personal Account of the Incident: Write down a detailed account of the incident while it’s fresh in your memory. Include every detail, no matter how small it may seem.

  11. Dog Owner Information: Gather as much information as possible about the dog and its owner, including the dog’s breed, size, name, and the owner’s contact details.

Providing this comprehensive set of evidence to your attorney will help them to understand the full extent of the incident and build a strong case on your behalf. Remember, each dog bite case is unique, so your attorney may need additional specific information related to your case.
